Below, lawyers from the National Center for Agricultural Law have identified and summarized the key legal and policy developments that have affected agriculture in 2021, including many that will continue to do so in the years to come. Dr. Bart Fischer and I recently co-authored an article for Southern Ag Today about the current legal status of Section 1005 of the 2021 U.S. Bailout. This provision required the USDA to pay socially disadvantaged farmers and ranchers “up to 120% of the outstanding debt” of eligible producers for direct and guaranteed loans managed by USDA agencies. After President Biden took office in January, his administration issued an executive order requiring federal agencies to review actions taken by agencies during the previous administration.
